The Locum Contract agreement
By registering with us and accepting any bookings, you (the locum) agree to be legally bound by these terms with us (Naimas Pharma Ltd) for the entire duration of your registration. These terms apply to all bookings, whether you take them or not. These terms can only be changed if we give you written approval. You or we can end this contract at any time by writing to each other.
Locum’s obligations:
- To work with us, you need to have the right to work in the UK and show us proof of this when you first register.
- If you are a locum pharmacist or technician, you need to be registered with the General Pharmaceutical Council (GPhC) and follow the GPhC Code of Ethics.
- You need to understand that you are self-employed and responsible for paying your own tax and national insurance according to the rules of Her Majesty’s Revenue and Customs.
- You need to have a valid and current Indemnity Insurance and agree to send us a copy every year.
- You need to have the necessary skills and qualifications for the pharmacy role and keep improving your learning through the CPPE programme. You must behave professionally during any bookings, respect the shift times, follow the client SOPS and comply with the store Health & Safety requirements.
- You must inform us of any changes in your situation that may affect your work.
- You agree to let us process your personal data for the purpose of booking locum work and its procedures as explained in our Privacy Policy.
Bookings:
- You agree to be responsible for any harm or damage caused by your negligence during a booking.
- You have the right to decline any bookings we offer you, but you must keep the client details and rates confidential between us.
- When you accept a placement, you are legally obliged to work.
- If you cannot attend the booking, you must notify us as soon as possible and suggest another locum who is registered and verified by us.
- You acknowledge that there may be times when no suitable work is available.
- After you verbally accept a booking, we will send you written details including the date and shift time, the client’s identity, the agreed hourly and travel rates, and any other relevant information. You must raise any questions, issues, or changes before the booking date.
- We do not determine hourly rates, but we will try to negotiate them on your behalf where possible.
- Locums should arrive at the booking at least ten minutes before the shift starts. This is to allow locums to meet the dispensary team, read the client’s SOPs, and familiarise themselves with the store’s health and safety policy, which you must follow.
- If you are a pharmacist, you must display your Responsible Pharmacist certificate at all times.
- The client will pay you directly, not us. We will support you with any payment issues.
- If the client wants to hire you before, during, or within six months after the first agreed booking, you understand that we are entitled to charge the client a fee. You agree to inform us of this and give us the store name or number that is employing you.
- The client may cancel your confirmed booking and we are not responsible or liable for any financial loss. We will try to find you alternative work but we cannot guarantee this.
- You must declare any direct bookings to us.
Confidentiality:
You must keep all the bookings and communication that you receive from Naimas Pharma as a secret and not share it with anyone else. This is to protect our business operation and the trade secrets of our Clients.
Termination of this contract:
You can end this contract at any time by writing to us. However, you still need to tell us if you work directly with any of our Clients within 6 months after ending the contract. These are the Clients that you have worked with while registered with us. After we receive your written notice, we will delete all your personal data according to our Privacy Policy.
Law:
The courts of England & Wales have the final say on any disputes about these terms, and only the laws of England & Wales apply to them.
